PHONEBOX USA ACCEPTABLE USE POLICY (AUP)
This Acceptable Use Policy (“AUP”) applies to all persons or entities using PhoneBox USA Services (“you,” “your,” or “user”) and governs your use of PhoneBox wireless products, features, platforms, networks, software, tools, websites, applications, and services (collectively, the “Services”).
PhoneBox USA (“PhoneBox,” “we,” “our,” or “us”) provides wireless telecommunications services as a Mobile Virtual Network Operator (MVNO) operating on the T-Mobile network (the “Wireless Network”, together with PhoneBox infrastructure and systems).
This AUP is incorporated into and forms part of your Wireless Customer Agreement and applies in addition to all other applicable terms, conditions, and policies.
1. GENERAL USE OF SERVICES
PhoneBox permits standard consumer use of Services, including:
Voice calling
Messaging (SMS/MMS)
Internet browsing
Email and communication services
GPS navigation
Streaming and downloading content
Other customary mobile internet-enabled activities
However, certain uses of the Services or your Device(s) are prohibited, including those that are unlawful, abusive, harmful to the network, or inconsistent with reasonable personal use.
IMPORTANT: PhoneBox rate plans are designed for typical consumer usage patterns and are not intended for heavy, continuous, or substitute broadband usage, even on high or unlimited data plans.
2. PROHIBITED ACTIVITIES
You may not use the Services or your Device(s) in any manner that violates this AUP, the Wireless Customer Agreement, applicable law, or that harms PhoneBox, the Wireless Network, or other users.
PhoneBox may modify, suspend, restrict, or terminate Services without notice for violations including, but not limited to:
2.1 Contractual & Policy Violations
Any conduct that violates the Wireless Customer Agreement
Failure to comply with this AUP or related policies
2.2 Fraudulent, Abusive, or Excessive Use
Excessive, abnormal, or unusual usage patterns
Usage indicative of fraud, abuse, or non-personal use
Activity that interferes with or degrades network performance
2.3 Unauthorized Technical Manipulation
You may not:
Copy, decompile, reverse engineer, disassemble, or modify Services or software
Attempt to derive source code or defeat security mechanisms
Combine Services with unauthorized software or create derivative works
Tamper with, reprogram, or alter Devices to bypass restrictions
Circumvent SIM or eSIM protections, including encryption or encoded data
2.4 Resale and Commercial Exploitation
Resell or attempt to resell Services, whether standalone or bundled
Use Services for commercial redistribution or wholesale purposes without authorization
2.5 Unlawful or Harmful Conduct
You may not use Services in any way that:
Violates any law, regulation, or legal obligation
Interferes with the use or enjoyment of Services by others
Requires a plan or feature you have not subscribed to
Is inconsistent with normal personal use (e.g., mass calling or bulk messaging)
Exceeds roaming or off-network usage limits
Disseminates false, misleading, or deceptive content
Publishes or transmits threatening, obscene, or offensive material
Involves sexually explicit content where prohibited
Generates spam or abusive communications
Harasses, threatens, or harms others
Masks or falsifies sender identity (e.g., spoofing)
Promotes violence, discrimination, or illegal activity
Creates significant customer complaints or complaints to regulators
3. NETWORK MISUSE AND PROHIBITED DATA USAGE
You may not use Services in a way that causes or could cause network congestion, degradation, or interference.
Examples of prohibited uses include:
3.1 Server and Automated Usage
Operating servers or hosting services on the network
Continuous unattended connections (e.g., telemetry, machine-to-machine, SCADA)
Automated data feeds or broadcast streaming systems
Peer-to-peer (P2P) file sharing
3.2 Broadband Substitution / Network Abuse
Using Services as a substitute for home internet or dedicated broadband
Redirecting television signals or streaming to other devices
Continuous “always-on” connections or “keep-alive” processes
Excessive tethering or hotspot usage beyond plan limits
3.3 Messaging and Communication Abuse
Sending spam or bulk unsolicited messages
Using auto-responders, bots, or scripts generating excessive traffic
Bulk messaging campaigns not intended for person-to-person communication
3.4 Device and SIM Misuse
Using SIM cards in unauthorized devices (e.g., laptops without proper plan)
Using Services primarily on non-phone devices without appropriate plans
Circumventing device or plan restrictions
3.5 Network Security Violations
Attempting to access accounts, systems, or networks without authorization
Attempting to breach or test network security
Conducting denial-of-service (DoS) attacks
Interfering with other users’ access to network resources
4. DETERMINATION OF EXCESSIVE USE
PhoneBox reserves the sole and absolute discretion to determine what constitutes:
Excessive or abnormal usage
Heavy data consumption inconsistent with your plan
Network abuse or harmful behavior
This determination may be based on:
Data usage volume and patterns
Device types used on your account
Duration and frequency of sessions
Comparison to typical consumer usage
Any other method we deem appropriate
5. PHONEBOX RIGHTS TO ENFORCE COMPLIANCE
You agree that PhoneBox may take any action necessary to enforce this AUP, including:
5.1 Service Restrictions and Termination
We may, without prior notice:
Interrupt, suspend, restrict, or terminate Services
Modify or limit features or access
Reduce data speeds (throttling)
Disable specific functionalities (e.g., hotspot/tethering)
If Services are suspended or terminated due to violation:
Charges will not be prorated
You will not receive refunds or credits for unused Services
We may provide notice of violations (e.g., via email, SMS, or account alerts), but are not obligated to do so.
5.2 Network Management Practices
We may implement reasonable network management measures to:
Maintain network integrity and performance
Reduce congestion
Allocate bandwidth efficiently
Adapt to evolving technologies
Ensure fair usage among customers
These measures may include:
Speed reductions after usage thresholds are exceeded
Prioritization of network traffic
Temporary or permanent usage restrictions
Usage thresholds may apply even on unlimited plans, and you will be notified of applicable thresholds via:
Billing statements
Email or SMS
Website disclosures

5.3 Monitoring

Investigate suspicious or harmful activity
5.4 Policy Updates
We may revise this AUP at any time by posting an updated version on our website. Continued use of Services constitutes acceptance of the updated policy.

By using PhoneBox Services, you acknowledge and agree that:
You have read and understood this Acceptable Use Policy
You will comply with all terms and conditions
Violations may result in immediate action, including service suspension or termination
